Terms of sale

These general conditions of sale govern the sale of products marketed by Giurgola srl. All contracts for the purchase of products through the site www.kloris.it and according to the procedures described above, between the seller and the customer will be governed by these Terms. 

Acceptance of the terms of sale. 

The contract between Giurgola srl and the Customer shall be concluded with the acceptance, even partial, of the order by Kloris, which reserves the right, at its sole discretion, to accept the order. The acceptance is automatic, unless otherwise communicated to the client. 
By placing an order in the manner provided, you acknowledge that you have read all the information provided during the purchase procedure and accept the general conditions and payment transcribed below. 
If the customer is a consumer (ie a person who buys goods for purposes not related to his profession), once the online purchase procedure, will print or save an electronic copy, but keep, the present general conditions of sale, subject to the requirements of Art. 3 and 4 of Legislative Decree no. 185/1999 on distance selling. It excludes any right of the Customer to damages or compensation, and any contract or tort liability for any direct or indirect personal and / or property, caused by the rejection, even partial, of an order. 

How to purchase. 

The Customer may only purchase products in the electronic catalog of Giurgola srl when placing your order and the address (URL) https://www.kloris.it, as described in the relevant information sheets. These products are intended sold as illustrated and / or described in the relevant information sheets. 
It is understood that the picture accompanying the description of a product may not be fully representative of its characteristics, and differ in color, size, and accessories in the picture. 
These differences, from the moment they do not relate to the details of the products and does not affect their quality, can not justify cancellation of the order or a refusal of delivery. 
All prices on the site are inclusive of VAT. Giurgola srl reserves the right to change prices at any time, without notice. 
It excludes any right of the Customer to damages or compensation, and any contract or tort liability for any direct or indirect personal and / or property, caused by the rejection, even partial, of an order. 

Payment methods. 

Giurgola srl only be shipped in Italy 
For every order placed on www.kloris.it, Giurgola srl invoices of material sent on request. 
For the issuance of the invoice, to the information provided by the Customer. 
No change in the bill will be possible after the issuance thereof. No responsibility can be attributed to Giurgola srl in case of delay in the order or delivery of goods ordered. 

Indications for proper withdrawal of delivery. 

Upon delivery of the goods by the courier or postal service, the customer is required to check: 
that the material being delivered is as ordered, that the packaging is not damaged, or wet or otherwise altered, including the sealing materials (adhesive tape or metal). 
Any external damage or the mismatch in the number of packages or particulars, must be immediately reported to the carrier making the delivery, adding the word "withdrawal conditional" on the appropriate document and confirmed within 8 days by registered letter with acknowledgment of return to the courier, whose address is explained on the accompanying document. 
In the specific case of damaged package to write "subject to removal because the package is damaged." 
If you fail to collect within 5 working days of the material in storage at the warehouses of courier or mail because of repeated inability to deliver to the address specified by the Customer, the order will be automatically canceled. In this case and in all cases where the goods can not be delivered to the customer for reasons not attributable to error or omission on the part of Giurgola srl or conveyor where the gear was entrusted, the order will be automatically canceled and will Giurgola srl refund the Customer the amount paid reduced the amount of all expenses incurred up to that point. 

Delivery times and costs. 

Due to differences in volume and weight of the shipping costs are indicative only and these will be communicated before the 'order fulfillment. 
Even the delivery of the goods ordered are for guidance only; 
the same may be subject to change due to force majeure or because of traffic conditions and road conditions in general or by the Authority. 

Right of withdrawal. 

Under Article. 64 et seq of Legislative Decree. N. 206/2005, if the customer is a consumer (ie a person who buys goods for purposes not related to his professional activity, or does the purchase by indicating in the order form to Giurgola srl a reference to VAT), has right to terminate the contract for any reason, without explanation and without penalty, except as described in the following point. 

The right of withdrawal does not apply to customized products or reservation! 

To exercise this right, the customer must send Giurgola srl a notice to that effect, within 10 working days from the date of receipt of goods. Such notice shall be sent by registered letter with acknowledgment of receipt, addressed to: Giurgola srl - Km 14.500 to 73,013 Galatina (Lecce) 
or by telegram or fax sent within the said period of 10 days and followed by a confirmation letter with acknowledgment of receipt, sent out until 48 hours. Once such notice of withdrawal, the Customer Service Giurgola srl will quickly inform the customer instructions on how to return the goods that must be done within the next 48 hours. 

The right of withdrawal is subject to the following conditions: 
the law does not apply to custom products that is specifically performed on specific or customer's design as well as products that are modified or assembled with other customer's request. 
The products must be returned intact and in original packaging, complete in all its parts (including packaging and any documentation and accessories) to limit damage to the original package, we recommend, when possible, to put it in another box. 
Shipping costs for the return of the asset are charged to the customer; 
the shipment until the certificate of receipt in our warehouse is under the responsibility of the customer; 
if the goods are damaged during transport, Giurgola srl will inform the customer (within 5 days of receipt of goods in their stores), to enable him to file a timely complaint against the carrier of his choice and to obtain reimbursement the value of the property (if insured); in this case, the product will be made ​​available to the client for his return, while canceling the request for withdrawal; 
Giurgola srl not responsible in any way for damage or theft / loss of goods returned by uninsured shipments. 
Without prejudice to any repair costs for damage to the original package, Giurgola srl will refund the customer amount already paid to reduced expenditure of all expenses incurred in the processing and shipping of the order as well as for the collection and return of payment. Unless otherwise specified by the customer the refund will be made ​​by bank transfer within 14 days of return of goods. The Buyer shall promptly provide to the bank on which the reimbursement (Cod. ABI - CAB - Account of the invoice). 
The right of withdrawal is lost for lack of the essential integrity of the property (the packaging and / or its contents), in cases where Giurgola srl finds: 
the lack of external and / or internal packaging; 
the absence of product components. 
damage to the product for reasons other than transportation. 
In case of forfeiture of the right of withdrawal, Giurgola srl will return to sender the property purchased, upon payment by the same shipping costs. 


We guarantee that our products are 100% Made in Italy and manufactured in our factories. 
The products are guaranteed against any lack of conformity and hidden defects under the conditions provided by the provisions of the Consumer Code and the Civil Code. 
During the warranty period, Giurgola srl will, at its option, replace or refund defective products recognized by its services. The products replaced under the guarantee for the remaining duration. Excluded are: 
the consumption of the product resulting from normal wear and tear according to its nature, function, composition and price; 
slight differences observed on products such as defined in paragraph "2- How to Buy"; 
products that are used in too intensive, or for purposes other than those for private use; 
any defects in the product that may result from poor installation, storage, keeping or assembly (non-compliance of the installation instructions), by a lack of maintenance, misuse or use not in accordance with the technical specifications or use (failure to comply with the requirements of maintenance and maintenance), modifications or repairs made ​​by the purchaser or a third party, deterioration caused by external objects, external events such as accidents, strikes, fires, vandalism, loss of pipelines, natural or artificial light (in case of discoloration) , natural disasters or weather. 
These repairs during the warranty period are guaranteed by Giurgola srl at its headquarters. Transport costs for sending it in for repair and return of the repaired product shall be borne by the customer, unless otherwise specified in the order. 
If, following the intervention of assistance from Giurgola srl , the problem of origin NOT be found to be a defect of non-compliance under warranty, the customer will be charged the cost of testing, verification and recovery may be provided by our assistance. 
In the event that, for whatever reason, is unable to make its customers a product warranty (repaired or replaced), Giurgola srl will proceed at its own discretion to refund the amount paid or to replace it with a product of characteristics equal to or greater. 
No damage can be obtained from Giurgola srl for any delays in repairs or replacements. 
In all cases, the right to repair or replace must be returned by Customer in its original packaging, complete in all its parts (including packaging and any documentation and accessories);to limit damage to the original package, we recommend, when possible, to put it in another box. It will require the presentation of the original invoice to qualify for the guarantee. 

Responsibility of Giurgola srl . 

The responsibility of Giurgola srl on products delivered, including the one in the framework of the applicable legal or contractual guarantees, is limited to the price of the defective or non-conforming. 
Giurgola srl not be held to compensation for consequential damages or any other financial loss incurred by the purchaser or a third party.
